Dear Yang Ming Customers,
Pursuant to the United States Federal Maritime Commission’s Final Rule on Detention and Demurrage Billing Practices which was issued on February 26, 2024 and is scheduled to go into effect on May 28, 2024, Yang Ming will implement the following changes that concern which entities can be properly billed, the timing for invoices to be sent, and the provision of information on dispute resolution.
DEMURRAGE
Customers should continue paying demurrage invoices to the Marine Terminal Operator (MTO), eModal, or Yang Ming directly for shipments arriving at select MTOs.
Properly Billed Party
For US Import Demurrage, the Billed Party is the “Consignee” on the B/L
For B/Ls where the Consignee has not accepted the B/L or is “To Order’, the Billed Party is “Contracted Party (i.e. Shipper)”.
For US Export Demurrage, the Billed Party is the “Shipper” on the B/L
DETENTION
Properly Billed PartyFor US Import Detention, the Billed Party is “Consignee” on the B/L
For B/Ls where the Consignee has not accepted the B/L or is “To Order”, the Billed Party is the “Contracted Party (i.e. Shipper)”.
For US Export Detention, the Billed Party is "Shipper” on the B/L
All invoices will be issued within thirty (30) calendar days from the date the charges accrue. Customers may submit a dispute to an invoice by contacting Yang Ming listed in FAQ in Local Website(Demurrage&Detention/ FAQ) Disputes should be submitted by no later than thirty (30) calendar days from the invoice date.
