YANG MING (UK) LIMITED Export booking Rules & notes of guidance

1. Please check the booking confirmation sent, which details the booking made in accordance with the information provided. Should any of the details contained within the booking confirmation require amendment, please telephone Yang Ming (UK) Limited immediately on 01708 776925 and confirm in writing on e-mail to booking@uk.yangming.com Yang Ming (UK) Limited does not accept any responsibility for any costs and/or consequences incurred resulting from information provided verbally that is subsequently disputed from what is indicated within the booking confirmation.

2. YMUK Reserves the right to charge a cancellation fee in event of any booking being reduced or cancelled after booked vessel receiving at the port of Loading has commenced. This fee also applies when a customer reduces the number of containers in a booking, transfers container(s) to a different vessel or if container(s) fail to arrive before terminal cut-off. The charge also applies to "Lost slots" in event of OOG bookings.

3. Please note any haulage cancelled after 1pm on the working day prior to the day of loading will be subject to a wasted journey charge being applied at the full and actual cost of the journey. This actual charge may be significantly higher than the inland haulage rate quoted . Bookings cancelled prior to 1 pm on the working day prior to the day will be considered on a case by case basis and if a charge has been incurred, this will be for the account of the booking party. Booking cancellations are to be advised by telephone immediately on 01708 776925 and confirmed in writing on e-mail to booking@uk.yangming.com

4. Whilst every effort will be made to position container (s) at the date & time requested, Yangming (UK) Ltd does not accept responsibility for any extra charges and / or liabilities howsoever arising including, but not limited to any consequential losses, as a result of unforeseen delays howsoever incurred.

5. The vehicle / container provided will be suitable to carry the payload declared at time of booking . Any claims, liabilities, further costs, expenses and/or fines associated with, arising from or incurred as a result ( including by virtue of the denial of a defence) of, a container weight being mis-declared , will be for merchants account.

6. It is the responsibility of the merchant to ensure that the payload of containers loaded for export shipment does not exceed the maximum payload of the container provided and/or the limits allowed by the laws of the countries of origin and destination.

7. 3 hours are allowed to complete the loading of the container, from booked load time or arrival time of the container at the merchants premises whichever is the latter. A detention rate of GBP 45 per hour or part is applicable thereafter . However should the cargo not be immediately available upon arrival of the vehicle, or in Yang Ming (UK) Ltd's opinion the vehicle is delayed at the load point for an unreasonable period of time, then Yang Ming (UK) Ltd reserves the right to withdraw the vehicle and all costs arising from this action will be for the merchants account. These costs could be significantly higher than your quoted inland haulage.

8. All containers must arrive on quay the working day prior to vessel arrival and UCR data not advised at time of booking must be provided to the YMUK business support department on e-mail to booking@uk.yangming.com in a timely fashion in order this information may be updated in to the Port's computer system (Destin8 or CNS) linked to CHIEF prior to cargo arriving at the port in order clearance for export shipment may be obtained.

9. It is merchants responsibility to provide VGM data within sufficient time prior to the vessel VGM cut-off, this is available on request.
YM require following VGM data to be provided, failure to do so may result in additional costs for merchants account:
VGM weight
Method of weighing (SM1 or SM2)
Name of party providing the declaration
Authorised name/signature

10. Any containers delivered to the port of Loading prior to vessel opening date, will be subject to vessel re-nomination, location change & Demurrage charges at Yang Ming's tariff rate applicable at time of shipment. All other ports may also be subject to conditions & charges as per local practice, details available on request.

11. In the interests of security and to satisfy the requirements of Customs Authorities in some countries, bolt seals provided by Yang Ming must be affixed to all containers. It is the Merchants responsibility to ensure that a Yang Ming bolt seal is securely affixed to the container before departure from the merchants premises and the seal number recorded for inclusion on the bill of lading.
Yang Ming (UK) Limited respectfully advise, failure to declare the seal number (s) on your shipping instructions will constitute Yang Ming considering the shipping instructions incomplete. A delay in documentation production will occur whilst said information is sought & moreover, a charge will be imposed of £50 per container to cover additional costs incurred obtaining said missing information.
Any claims, liabilities, further costs, expenses and/or fines associated with, arising from or incurred as a result ( including by virtue of the denial of a defence) of, a container not being sealed or being sealed with anything other than a secure Yang Ming bolt seal and/or the merchant failing to record and provide the seal number in good time, shall be for the Merchants account.
Customers are also directed toward the Yang Ming Marine Transport Corpn bill of lading & in particular clause 9 - 'Container packed by merchant - merchant's responsibility'.

12. If hazardous cargo forms any part of the load, please confirm all details in writing immediately to booking@uk.yangming.com. Please allow at least 3 working days prior to loading to enable processing.
Hazardous cargo must be presented by the shipper for shipment in accordance with the IMDG code and additional regulations pertaining to the country of destination . Containers must be properly placarded & be accompanied by a signed packing certificate.
Hazardous containers delivered to the port by the merchant prior to acceptance by Yang Ming (or in the case of a chartered vessel, the relevant vessel operator), are at the merchants own risk. The Merchant accepts that carrier haulage can only be arranged once cargo is accepted by Yang Ming and/or the relevant vessel operator. Furthermore, transport arrangement may require 2 working days between time of acceptance and loading time.

13. If out of guage cargo forms any part of the booking, the merchant is responsible for providing accurate dimension, length, width & height, & gross weight which is to include any securing materials utilised.

14. If refridgerated cargo forms any part of the booking, please ensure you have advised the correct temperature setting & that this is confirmed on the booking confirmation sent to you. It is also important to advise whether container vents are to be open or closed

15. For merchant haulage bookings.
Once loaded, customer must provide on email to log@uk.yangming.com & cc booking@uk.yangming.com, details for terminal booking according to below format.

16. Yang Ming (U.K.) Ltd reserves the right to cancel the booking made if, in their reasonable opinion, the customer has failed to provide adequate information and / or instructions or has provided inaccurate information relating to the goods. In such circumstances any claims, liabilities, further costs, expenses and/or fines associated with, arising from or incurred as a result ( including by virtue of the denial of a defence) of, shall be for the Merchants account.

17. Export cargo shipping instructions are to be provided in a timely manner prior to vessel departure by e-mail to doc@uk.yangming.com or fax to 0203 006 8853. Shipping instructions should detail the container no(s) & seal no(s) & additionally, whether required as part of the bill of lading or not, the piece count, gross cargo weight & measurement for each container.

18. For all destinations requiring an AMS (Advanced Manifest Submission), bill of lading instructions must be submitted a minimum of 2 working days prior to vessel arrival at the port of loading. Any containers loading after this cut-off are at merchants risk and still require skeleton instructions to be submitted by the deadline with full instructions to be submitted no later than 2 Hrs after final container on consignment has been loaded. Failure to provide bill of lading instructions prior to deadline will incur late instruction fee of USD 200.00 and may also risk short shipment. Any and all charges incurred for short shipment will be for your account.

19. Any Bills of lading requiring amendment after AMS submission will automatically incur a fee of USD 50.00 (75.00 Mexico) for each manifest amendment submitted. These include any amendments necessary due to only Skeleton instructions being initially provided.

20. For Non AMS destinations bill of lading instructions must be submitted before vessel departure, any submitted after deadline will automatically incur late instruction fee USD 100.00.
